Terms and Conditions

These Terms and Conditions (Terms) govern the provision of hypnotherapy and personal coaching services (collectively, the Services) by Guidestone Coaching (we, us or our) to any individual or entity (you or Client). By booking or attending any session, purchasing any audio track, or otherwise engaging with us, you confirm that you have read, understood, and agree to be bound by these Terms.

  1. Definitions and Interpretation

    1. Definitions

      In these Terms:

      • Agreement means the contract formed between you and us incorporating these Terms and any Booking Confirmation.

      • Audio Tracks means pre-recorded or bespoke hypnosis audio products available for purchase or download through our online shop.

      • Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).

      • Booking Confirmation means our written confirmation (including by email or SMS) of your appointment.

      • Business Day means a day other than a Saturday, Sunday or public holiday in the State or Territory where the Services are provided.

      • Coaching means goal-oriented, future-focused conversations intended to support personal or professional development.

      • Guidestone Coaching means LACHLAN CHARLES CONNELLY (ABN 73 981 373 036).

      • Hypnotherapy means therapeutic interventions delivered in a hypnotic state, designed to facilitate positive behavioural or cognitive change.

      • Session means any scheduled appointment for Hypnotherapy or Coaching.

    2. Interpretation

      Headings are for convenience only and do not affect interpretation. Words in the singular include the plural and vice versa.

  2. Client Eligibility

    1. You must be at least 18 years of age to participate in any Session. Client’s under the age of 18 must be accompanied by a parent or guardian.
    2. You warrant that you are capable of giving informed consent and do not have any condition that would render hypnotherapy or coaching unsuitable without prior medical advice
    3. We reserve the right to decline or discontinue the Services if, in our reasonable opinion, they are not appropriate for your circumstances.
  3. Nature of Services (Hypnotherapy and Coaching)

    1. Hypnotherapy and Coaching are complementary wellness modalities. They are not a substitute for medical, psychological, or psychiatric treatment.
    2. Results vary between individuals and cannot be guaranteed. Your commitment and active participation are essential to success.
  4. Bookings and Cancellations

    1. Appointments are made via our online booking system, email, or telephone and are confirmed once you receive a Booking Confirmation.
    2. Rescheduling or cancellation must be made at least 48 hours before the scheduled Session. Late changes may incur a fee up to the full Session price.
    3. We may cancel or reschedule a Session due to unforeseen practitioner illness or emergency. In such cases, we will offer the next available appointment or a refund of any pre-paid fee for that Session.
  5. Fees, Payment, and Refund Policy

    1. Current fees are listed on our website or quoted in writing. All amounts are in Australian Dollars (AUD) and inclusive of GST unless stated otherwise.
    2. Payment is due in full at the time of booking unless we agree otherwise in writing. We accept the payment methods listed on our website (e.g., credit/debit card, BPay, bank transfer).
    3. Interest may be charged on any outstanding amount not paid by the due date for payment. Interest will be calculated at the rate from to time fixed by the Penalty Interest Rates Act 1983 (Vic) and will accrue daily from the due date of payment until paid in full
    4. Refunds
      1. Sessions: Cancellations within the 48-hour window are non-refundable unless required by Australian Consumer Law.
      2. Audio Tracks: Due to the digital nature of the product, sales are final and non-refundable once the download link has been provided.
  6. Referral Program

    1. Clients who refer others to Guidestone Coaching are eligible to receive a cash gift equal to 10% of the total value of services purchased by the referred person, up to an aggregated maximum of $10,000 AUD per client. To qualify:
      1. The referred person must mention your name at the time of booking;
      2. Payment for services must be completed in full by the referred client;
      3. Referrals must be new clients who have not previously engaged with Guidestone Coaching.
    2. Cash gifts will be issued via bank transfer or another method agreed between both parties within 30 days of the referred client's full payment.
    3. We reserve the right to modify or discontinue the referral program at any time.
  7. Full Breakthrough Program Guarantee

    1. We guarantee that our "Full Breakthrough" program will continue until your primary objective has been resolved, or a full refund will be provided. This guarantee is conditional upon the Client fully participating in the program, including:
      1. Attending all one-on-one scheduled Sessions;
      2. Completing any action steps or homework assigned;
      3. Providing honest feedback and communication during the course of the program.
    2. This guarantee becomes void if the Client fails to follow the agreed action plan or otherwise disengages from the program.
  8. Intellectual Property (Audio Tracks)

    1. All Audio Tracks and related materials remain the exclusive intellectual property of Guidestone Coaching. Purchase grants you a personal, non-transferable, non-exclusive licence to download and use the Audio Tracks for your own private purposes.
    2. You must not reproduce, share, distribute, transmit, modify, or otherwise exploit the Audio Tracks without our prior written consent.
  9. Confidentiality and Privacy

    1. We handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy (available on request).
    2. Information you provide, including name, contact details, emergency contact details, session notes, and medical history, are stored on secure, encrypted servers located in Australia.
    3. We will not disclose your information to third parties except:
      1. With your express consent;
      2. Where required by law; or
      3. If we reasonably believe disclosure is necessary to prevent serious and imminent threat to life, health, or safety.
  10. Client Responsibilities and Disclaimers

    1. You agree to:
      1. Provide complete and accurate information relevant to your wellbeing;
      2. Attend Sessions sober and free from the influence of drugs or alcohol;
      3. Follow reasonable instructions and therapeutic homework between Sessions;
      4. Consult your medical practitioner as necessary.
    2. You acknowledge that lifestyle factors outside our control (e.g., diet, exercise, stress) can influence outcomes.
  11. Medical Disclaimer

    1. We are not qualified medical practitioners and do not diagnose conditions, prescribe medications, or interfere with treatment prescribed by a licensed medical professional.
    2. Always seek the advice of your medical physician or other qualified health provider regarding any medical condition. Never disregard professional medical advice because of something you have heard in a Session or Audio Track.
  12. Liability and Limitation of Claims

    1. General Limitation
    • To the maximum extent permitted by applicable law, including the Australian Consumer Law and any relevant state legislation, our liability for any claim arising under or in connection with these Terms (whether in contract, tort, statute or otherwise) is strictly limited to:

      1. Supplying the Services again; or
      2. Payment of the cost of having the Services supplied again.
    • For the avoidance of doubt, we accept no responsibility for any injury, harm or damage suffered as a result of any failure by you to follow our instructions or directions in respect of using any Audio Track, including but not limited to using Audio Tracks while driving, operating machinery or engaging in any activity requiring full alertness.

    1. Exclusions of Indirect Loss
    • We shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from or related to the use of the Audio Tracks or Services provided under these Terms, except where such liability cannot be excluded under the Australian Consumer Law or other applicable laws.
    1. Consumer Rights
    • You retain the benefit of any non-excludable guarantees, rights or remedies provided by the Australian Consumer Law or other applicable laws and nothing in these Terms seeks to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) and which by law cannot be excluded, restricted or modified.
  13. Code of Conduct

    1. We undertake to provide Services professionally, ethically, and in accordance with the International Institute For Complementary Therapists or equivalent professional code.
    2. Mutual respect is expected. Harassment, discrimination, or inappropriate behaviour by either party is grounds for immediate termination of Services.
  14. Emergency or Crisis Policy

    1. We are not a crisis service. If you feel at risk of harm to yourself or others, call 000 (within Australia), contact Lifeline 13 11 14, or attend the nearest hospital emergency department.
    2. We may terminate a Session if we believe you require immediate medical or psychiatric attention beyond our scope.
  15. Governing Law

    • These Terms are governed by the laws of the State of Victoria, Australia, and the parties submit to the exclusive jurisdiction of its courts.
  16. Changes to Terms

    • We may amend these Terms from time to time by posting the updated version on our website. Changes take effect immediately for new Clients or, for existing Clients, 14 days after notice (email or website) unless you object in writing before that date.
  17. Contact
